These Terms and Conditions (the "Terms") govern your access to and use of the website ddproperty.eu (the "Website") and the information and services offered through it (the "Services"). By accessing or using the Website, you agree to these Terms. If you do not agree, please do not use the Website.

1. Who we are

In these Terms, "we", "us" and "our" refer to VisionEdge s. r. o. The company was previously named Imagination Development, s. r. o.; it was renamed and its registration number is unchanged.

2. Our role and the nature of our Services

DD Property EU is a curated real estate agency. We present our own selection of properties located in Pattaya and the surrounding Chonburi province, Thailand, primarily to European and international clients, and we act as an intermediary that connects interested clients with property developers and sellers.

  • The Website is an information and presentation platform. It does not offer user accounts, user registration, or the ability for visitors to publish their own listings.
  • All property presentations are prepared or curated by us. We are not a classified-ads marketplace.
  • Contact is made through our contact form, our buyer or rental questionnaire, by phone, by email, or via messaging apps.
  • We do not conclude property sale contracts through the Website. Any purchase, reservation or lease is concluded separately, in writing, between you and the relevant developer or seller, with our assistance.

3. No buyer fees

We do not charge buyers or website visitors any commission or fee for using the Website or our advisory services. Our remuneration is paid by the property developers and sellers we work with. Any taxes, government fees, legal costs or transfer charges associated with an actual property transaction are governed by the relevant transaction documents and applicable Thai law, and are your responsibility unless agreed otherwise in writing.

4. Property information, prices and availability

  • Property descriptions, images, sizes, floor plans, features and prices are provided for general information and may be updated, corrected or withdrawn at any time without notice.
  • Prices are indicative and, unless stated otherwise, are quoted in Thai Baht (THB). Any amount shown in another currency (for example an approximate EUR figure) is for guidance only and depends on the exchange rate at the time.
  • Availability is not guaranteed. A property shown on the Website may already be reserved or sold.
  • Before making any commitment, you should independently verify all material facts, including legal title, ownership structure, areas and condition, with the assistance of qualified local professionals.

5. No professional advice

The information on the Website is provided for general informational purposes only and does not constitute legal, tax, financial or investment advice, nor a recommendation to enter into any particular transaction. Real estate investment carries risk. You should obtain independent professional advice tailored to your circumstances before making any decision.

6. Acceptable use

When using the Website, you agree not to:

  • use the Website for any unlawful, fraudulent or harmful purpose;
  • copy, scrape, harvest or systematically extract content or images without our prior written consent;
  • attempt to gain unauthorised access to, interfere with, or disrupt the Website or its underlying systems;
  • upload or transmit any malicious code; or
  • submit false, misleading or another person's personal information through our forms.

7. Intellectual property

All content on the Website, including text, graphics, the DD Property EU name and logo, layout and software, is owned by us or our licensors and is protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable licence to view the Website for your personal, non-commercial use. You may not reproduce, distribute, modify or create derivative works from any content without our prior written consent. Certain property images may be owned by the respective developers and are used with permission.

8. Third-party links and content

The Website may contain links to, or content from, third-party websites and services that we do not own or control. We are not responsible for their content, accuracy, availability or privacy practices, and any dealings you have with such third parties are solely between you and them.

9. Disclaimer of warranties

The Website and Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we make no warranties or representations, express or implied, regarding the accuracy, completeness, reliability or suitability of the Website, its content or the properties presented, or that the Website will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special or consequential loss, or for any loss of profit, opportunity or data, arising out of or in connection with your use of (or inability to use) the Website. Nothing in these Terms excludes or limits our liability where it cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud. If you are a consumer, these Terms do not affect your mandatory statutory rights.

You agree to hold us harmless from any claims, losses or expenses arising from your misuse of the Website or your breach of these Terms.

Your use of the Website is also governed by our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference.

13. Governing law and disputes

These Terms are governed by the laws of the Slovak Republic, without regard to conflict-of-law rules. The courts of the Slovak Republic shall have jurisdiction over any dispute, except where mandatory consumer-protection law grants you the right to bring proceedings in your country of residence. If you are a consumer in the EU, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

14. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version, and changes take effect when posted on the Website. Your continued use of the Website after changes are posted constitutes acceptance of the updated Terms.

15. Severability and entire agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect. These Terms, together with the Privacy Policy, Cookie Policy and Disclaimer, constitute the entire agreement between you and us regarding your use of the Website.

16. Language

These Terms are written in English. Any translation is provided for convenience only, and the English version prevails in the event of any inconsistency.
